Q: What programs do you use?
A: I mainly use Photoshop CC for painting/drawing, for animations I use After Effects but I'm learning Live2D.
Q: What tablet do you use?
A: I use a Wacom Intuos Pro Small.
Q: What size is your canvas?
A: For illustrations I use 3889x5500 px 300 dpi, for other stuff it varies depending on its use.
Q: What brushes do you use?
A: For painting I mostly use Yimei Zhus brushes, Sam Nielson's and Sozomaika's and for lineart/sketching I use either the default brushes or Arucelli's brushes.
Q: Do you do requests or art trades?
A: Not really. If I do it's reserved only for my close friends.
Q: Can I use your art as an icon or header?
A: Yeah, feel free to do it! As long as you give proper credit ofc and it's for personal use only :)
terms of service
Please read through this section carefully before sending a request/commission. It contains important information to avoid misunderstandings and future problems. Beware that failure to follow this terms will result in termination of the commission.
This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:
Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use of the Work.
Client warrants that the character design, reference material and other intellectual property provided to the Artist are legally obtained and authorized for use by the Client.
If the client requests characters of IPs not belonging to them (e.g. fanart of existing characters), they are solely responsible for the use of commissioned work. The Artist holds no responsibility for DMCA claims due to the use of copyrighted characters.
Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.
Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.
Artist reserves the right to refuse projects or requests based on content, subject, or other reasons.
Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord or Twitter, VGen platform, Google document, or email. The details set forth by the Artist shall be agreed upon by the Client before work begins.
Work will be sent through a Google Drive link for download, e-mail is available as per Client’s request. Once complete, it is the Client’s responsibility to save the work, the Artist is not responsible for having copies of the artwork after 1 week of completion.
Artist will not create content that is extremely explicit, offensive, or inappropriate.
PAYMENT
Full payment must be done upfront for commissions under $300USD.
Payment plans are available for commissions over $300USD.
The Artist will start working on the Work as soon as the Client makes the full payment previously agreed upon.
REVISIONS
The Client may request up to 3 revisions during the sketching phase and only 1 minor revision after the Work has been completed.
Altering/making changes to the Work after its completion, is only possible if there was a communication error/misunderstanding or if the changes suggested are minimum. Otherwise the Client will be charged a fee.
Lack of communication on the Client's side and delays with approving the work in progress, will result in late delivery and will be the Client's responsibility.
DEADLINES
Work completion requires 1 week minimum. Saturdays and Sundays are excluded.
For more complex and larger orders the deadline will increase accordingly.
If there are any delays and adjustments to timeline, the Artist will inform the Client.
If the Client needs rush priority, an additional +20-50% rush fee of the final price will apply, depending on how large the order is and the timeframe given for completion.
USAGE AND RIGHTS
Artist Rights
The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.
If the Client requires a NDA (Non-Disclosure Agreement) meaning that the Artist can't share, publish or show work in progress and/or the Work on websites, social media, portfolios, public broadcast channels and more, a +40% privacy fee will apply and must be stated and agreed upon during the ordering process.
Client Rights
Client receives exclusive, non-transferable usage rights to the Work for personal use. Personal use means display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces.
Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.
Client must not edit or modify Work in any way without prior permission from the Artist.
Client may commission a third party to animate the Work as long as credit for the original work is given.
Basic Commercial usage rights are included. The Work may be used on public broadcast channels (ie. Twitch, Youtube), Discord, social media, etc. for monetization/profit purposes.
Full Commercial usage rights must be purchased separately and will have an additional charge of 2x or more the original commission cost.
Full Commercial rights means usage of Work for Merch, Ads, Prints, selling or reselling Work to another party, as a part of any product, or on another platform or any other monetized instances.
REFUNDS
No refunds are possible after work begins, unless if the Artist, for any reason, cannot complete the Work within the previously agreed deadlines.
Client has the right to request refunds 1 month after deadlines if Work has not been delivered and there was no agreed upon amendment to the timeline.
INTELECTUAL PROPERTY RIGHTS
Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
For avoidance of doubt, the Artist reserves the rights, and the Client has no rights to, reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate art, including without limitation, technologies that are capable of generating works in the same style or genre as the Work, unless the Client obtains the Artist's specific and express permission to do so.
Nor does the Client have the right to sublicense others to reproduce and/or otherwise use the Work in any manner for purposes of training artificial intelligence technologies to generate art without the Artist's specific and express permission.
